NJ law (P.L. 2006, c. 103), Known as the "New Jersey Civil Union Act", takes effect. This law allows New Jersey residents to form same-sex
civil unions and have all of the same benefits, protections and responsibilities that are granted to spouses in a marriage.
This act applies to
both small (2-50) and large (51+) group plans. Civil union partners will be treated the same as spouses in all aspects of enrollment and medical coverage, with the exception of COBRA coverage
(or other applicable provisions of Federal law). In this instance, the New Jersey law is pre-empted by the Federal Defense of Marriage Act, under which a civil union partner is not considered
to be a spouse.
